Public Private Partnerships (PPP) - Staffing and pupils
Who is responsible for teaching and the curriculum under any PPP agreement?
These statutory responsibilities remain within the public sector. The school authorities and the Department of Education (the Department) will continue to be responsible for teaching and all aspects of the curriculum.
What are the implications for staff?
This depends on the range of services provided under the PPP contract. All ancillary staff who transfer from the public to the private sector will be covered by the Transfer of Undertaking Protection of Employment Regulations (TUPE) is applied as appropriate. In addition school authorities are required to ensure that PPP contractors apply the ODPM (Office of the Deputy Prime Minister) Code to all transferred staff. Teaching staff are not affected by PPP projects
Who decides on size?
The size of a school is determined by the Department on the basis of long-term enrolment projections. The demand is therefore retained by the public sector.
